【Legislative Amendments Regarding Affiliate Advertising】
In March 2023, a bill amending certain parts of the Act against Unjustifiable Premiums and Misleading Representations was approved in the National Diet. To enhance deterrent measures against violations by businesses, provisions adding to the amount of fines and establishing direct penalties for false recognition of quality and misleading representations have been newly introduced. Furthermore, in October 2023, the “Guidelines on Measures for the Management of Provision and Representation of Premiums to be Taken by Businesses” was enforced. Under this regulation, businesses (advertisers) are restricted from providing products or services while concealing the fact that it is an advertisement or promotion.

【The Purpose of the Webinar】
These legislative amendments are targeted at businesses and are aimed at implementing measures to preserve an environment where consumers can rationally choose better products and services. However, in the context of the general consumers acceding your articles through blogs and social media, affiliate marketers who publish advertisements from businesses also need to have a thorough understanding of the legal regulations.
For this webinar, we have invited Attorney Koya Uemura, who is actively involved as an advisor for the Tokyo Digital CATS (Clean Advertising Team of Specialists), an initiative by the Tokyo Metropolitan Government aimed at rationalizing improper advertising representations on the internet, aligning with the Act against Unjustifiable Premiums and Misleading Representations. Attorney Uemura will provide a lecture on the fundamentals of the Act against Unjustifiable Premiums and Misleading Representations, as well as topics such as the subjectivity of representation in stealth marketing and the challenges in identification.
Additionally, we will address and respond to questions collected in advance from participants who wish to attend the webinar.
