─ A Lawyer Explains the Basics of the Act on Securing Quality, Efficacy and Safety of Products Including Pharmaceuticals and Medical Devices and the Act against Unjustifiable Premiums and Misleading Representations ─
ValueCommerce Co., Ltd. (Head office: Chiyoda-ku, Tokyo; Representative Director, President and CEO: Jin Kagawa) held a workshop for media operators themed on the proper communication of information in compliance with laws and regulations on Tuesday, November 18, 2025. Mr. Kenichiro Saito, a lawyer who has specialized in advertising regulations, was invited to clearly explain the basics of the Act on Securing Quality, Efficacy and Safety of Products Including Pharmaceuticals and Medical Devices and the Act against Unjustifiable Premiums and Misleading Representations at the workshop. The lecturer used examples to explain about expressions that should be avoided in social media posts and affiliate marketing, and how to respond to issues.
Details of the workshop (excerpt)
• What are stealth marketing regulations?
• Responses to stealth marketing regulations (acceptable and unacceptable examples)
• What is misleading representation?
• The basics of the Pharmaceutical and Medical Device Act (Article 68)
• Regulations on the advertising of unapproved pharmaceutical products
The lecturer systematically explained what affiliates and influencers should be mindful of when posting and sources of information to be referenced when they have difficulty making a judgement. Participants asked many more questions during the lecture, and some had submitted questions in advance. This was a reflection of their high degree of interest in advertising representations.
All participants who submitted valid responses evaluated the workshop highly, responding “I want to participate again in the future,” or “I want to participate, depending on details” when answering a questionnaire following the workshop. Many of the participants gave positive feedback regarding the content of the workshop, regarding it as practical and saying “It was helpful,” or “It was slightly helpful.”
Feedback from participants (excerpts from questionnaire results)
• The lecturer’s explanation was clear. It made me feel confident in communicating information in the future.
• The examples enabled me to have a better understanding. They clarified the points I should know when posting.
• I learned about practical examples of acceptable and unacceptable expressions that had been ambiguous to me as a product tester. It was very helpful.
